1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Logixtecs Solutions LLC ("Company," "we," "us," or "our") regarding your use of the Trucker's Routine mobile application and related services (collectively, the "Service").

2. Service Description

Trucker's Routine is a fitness and wellness application designed specifically for truck drivers. We provide:

• AI-powered workout recommendations
• Exercise tracking and progress monitoring
• Trip planning with fitness integration
• Personalized fitness tips and content
• Subscription-based premium features

3. Health & Medical Disclaimer

3.1 General Information Only

All workout programs, fitness advice, and health-related content provided through our Service are for general informational and educational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.

3.2 User Responsibility

You acknowledge and agree that:

• You are solely responsible for your own health and safety
• You should consult with a qualified healthcare provider before beginning any exercise program
• You should seek immediate medical attention if you experience pain, dizziness, or discomfort during exercise
• You assume all risks associated with using our Service and following any workout recommendations
• The Company is not liable for any injuries, health issues, or adverse effects resulting from your use of the Service

3.3 Pre-existing Conditions

If you have any pre-existing medical conditions, injuries, or physical limitations, you MUST consult with your doctor before using our Service. This is especially important if you have:

• Heart disease or cardiovascular conditions
• High blood pressure or diabetes
• Joint problems or chronic pain
• Any condition that may be affected by physical activity

3.4 Content Sources

Our workout recommendations are based on:

• General fitness knowledge and publicly available information
• User feedback and preferences
• AI-generated suggestions based on user inputs
• Industry best practices for general fitness

We make no warranties about the accuracy, completeness, or suitability of our recommendations for your specific health needs.

4. User Accounts

4.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4.2 Account Types

We offer different account types:

• Trial: Free trial period with access to premium features
• Individual: Personal subscription accounts
• Corporate: Company-sponsored accounts for employees

5. Subscriptions & Payments

5.1 Subscription Plans

Premium features require a paid subscription. Subscription fees are charged on a recurring basis (monthly or annual) until canceled.

5.2 Free Trial

New users receive a 30-day free trial of premium features. Your payment method will be charged automatically at the end of the trial period unless you cancel before the trial ends.

5.3 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By providing payment information, you authorize us to charge the applicable fees to your payment method.

5.3.5 Multi-Currency Pricing

We offer pricing in multiple currencies to serve our international user base. The currency displayed to you is based on your geographic location:

• United States: Prices displayed in USD (United States Dollars)
• Canada: Prices displayed in CAD (Canadian Dollars)

The price you see at checkout is the price you will pay. Currency is determined at the time of purchase and will remain in that currency for the duration of your subscription.

5.4 Cancellation

You may cancel your subscription at any time through the app settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial subscription periods.

5.5 Price Changes

We reserve the right to change subscription prices. We will provide advance notice of price changes, and you will have the opportunity to cancel before the new price takes effect.

5.6 Promotional Pricing and Grandfathering

Current Pricing (as of October 2025):

• Individual Plan - Early Bird: $7.99 USD/month or $10.99 CAD/month for first 12 months
• Individual Plan - Regular: $15.99 USD/month or $21.99 CAD/month after promotional period
• Corporate Plan - Early Bird: $5.99 USD/driver/month or $7.99 CAD/driver/month for first 12 months
• Corporate Plan - Regular: $12.99 USD/driver/month or $17.99 CAD/driver/month after promotional period

Grandfathering Policy: Existing subscribers who joined during a promotional period will maintain their promotional pricing for the duration specified. We value our early supporters and will honor the pricing you agreed to when you subscribed.

6. Data Collection & Privacy

6.1 Information We Collect

We collect and process the following types of information:

• Personal Information: Email address, phone number, name
• Profile Information: Age, gender, height, weight, fitness level, goals
• Usage Data: Workout history, app interactions, progress tracking
• Device Information: Device type, operating system, app version

6.2 How We Use Your Data

Your information is used for:

• Service Delivery: Providing personalized workouts and tracking progress
• Analytics: Improving our Service and understanding user behavior
• Marketing: Email and phone communication from Trucker's Routine and Logixtecs Solutions LLC
• Account Management: Managing subscriptions and customer support

6.3 Corporate Accounts

IMPORTANT FOR CORPORATE USERS: If you are using a corporate account provided by your employer, we may share your usage data, progress reports, and fitness metrics with your employer. This may include:

• Workout completion rates
• Activity levels and engagement
• Progress toward fitness goals
• Aggregate health and wellness metrics

By using a corporate account, you consent to this data sharing with your employer.

6.4 Data Sharing

We do not sell your personal information to third parties. We may share data with:

• Service providers (payment processing, analytics, email services)
• Corporate account sponsors (as described in 6.3)
• Law enforcement when required by law

6.5 Data Security

We implement reasonable security measures to protect your data, but no system is completely secure. You acknowledge that you provide information at your own risk.

7. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer or decompile the application
• Share your account credentials with others
• Use the Service to harass, abuse, or harm others
• Upload malicious code or viruses
• Scrape or data mine the Service

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Logixtecs Solutions LLC and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained from using the Service will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOGIXTECS SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or the like that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service
• ANY INJURIES, HEALTH ISSUES, OR ADVERSE EFFECTS RESULTING FROM FOLLOWING WORKOUT RECOMMENDATIONS OR USING THE SERVICE

11. Indemnification

You agree to indemnify, defend, and hold harmless Logixtecs Solutions LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any injuries or health issues you experience while using the Service

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data
• You remain liable for any fees owed

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state where Logixtecs Solutions LLC is registered, without regard to conflict of law provisions.

14.1 For Canadian Users

Canadian users are also protected by Canadian consumer protection laws, including:

• The Competition Act (Canada)
• Provincial consumer protection legislation
• Personal Information Protection and Electronic Documents Act (PIPEDA)

Nothing in these Terms limits your rights under Canadian consumer protection laws.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.
